Terms of Use

These Terms of Use ("Terms") govern your use of the Hearth app and services ("Hearth"), operated by John Frank Krueger. By downloading or using Hearth, you agree to these Terms. If you do not agree, please do not use the app.

1. Who can use Hearth

You must be at least 18 years old to create a paying caregiver account. You are responsible for keeping your account credentials secure and for activity under your account.

2. What Hearth is — and is not

Important. Hearth is a wellness and family‑connection app. It is not a medical device, does not provide medical, clinical, or emergency services, and must not be relied upon for urgent or life‑safety needs. In an emergency, call your local emergency number. Medication reminders and wellbeing context are conveniences, not a substitute for professional care or your own judgment.

3. Subscriptions, billing, and free trials

Hearth offers auto‑renewing subscriptions in two tiers — Hearth and Hearth + Health — billed weekly, monthly, or yearly, each starting with a 14‑day free trial.
Payment is charged to your Apple ID at confirmation of purchase.
Your subscription automatically renews unless turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
You can manage or cancel your subscription, and turn off auto‑renew, in your Apple ID account settings after purchase.
Any unused portion of a free trial is forfeited when you purchase a subscription. Prices are shown in the app and may vary by region.
A subscription unlocks features for everyone in your family circle — one price for the whole family.

4. Acceptable use

You agree not to misuse Hearth, including by attempting to access other users' data without authorization, disrupting the service, uploading unlawful or harmful content, or using Hearth to harass or harm others. You are responsible for the content you add and for having the right to share information about the people in your circle.

5. Your content

You retain ownership of the content you create in Hearth (messages, photos, voice notes, and similar). You grant us a limited license to store and process that content solely to provide the service to you and your circle. See our Privacy Policy for how we handle data.

6. Account deletion

You may delete your account and associated data at any time in the app: Settings → Delete account.

7. Disclaimers

Hearth is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error‑free, or that notifications will always be delivered on time.

8. Limitation of liability

To the fullest extent permitted by law, Hearth and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on the app for medical, safety, or emergency purposes. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the claim.

9. Changes

We may update these Terms from time to time. We will revise the "Effective" date above and, where appropriate, notify you in the app. Continued use after changes means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict‑of‑laws principles.

11. Apple‑specific terms

If you obtained Hearth through the Apple App Store, Apple's standard Licensed Application End User License Agreement (EULA) also applies and is incorporated by reference. Apple is not a party to these Terms and is not responsible for the app or its content; Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them.
