These Terms of Use ("Terms") govern your use of the Hearth app and services ("Hearth"), operated by John Frank Krueger. By downloading or using Hearth, you agree to these Terms. If you do not agree, please do not use the app.
You must be at least 18 years old to create a paying caregiver account. You are responsible for keeping your account credentials secure and for activity under your account.
You agree not to misuse Hearth, including by attempting to access other users' data without authorization, disrupting the service, uploading unlawful or harmful content, or using Hearth to harass or harm others. You are responsible for the content you add and for having the right to share information about the people in your circle.
You retain ownership of the content you create in Hearth (messages, photos, voice notes, and similar). You grant us a limited license to store and process that content solely to provide the service to you and your circle. See our Privacy Policy for how we handle data.
You may delete your account and associated data at any time in the app: Settings → Delete account.
Hearth is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error‑free, or that notifications will always be delivered on time.
To the fullest extent permitted by law, Hearth and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on the app for medical, safety, or emergency purposes. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the claim.
We may update these Terms from time to time. We will revise the "Effective" date above and, where appropriate, notify you in the app. Continued use after changes means you accept the updated Terms.
These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict‑of‑laws principles.
If you obtained Hearth through the Apple App Store, Apple's standard Licensed Application End User License Agreement (EULA) also applies and is incorporated by reference. Apple is not a party to these Terms and is not responsible for the app or its content; Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them.
